Who determines who is at-fault for a Florida car accident?

When you’re making a claim in a Florida car accident case, then the first entities that are going to be involved are the insurance companies. Typically, they’ll conduct an investigation, and based on their interview of witnesses and their statements that were provided by all the parties, the insurance companies will make a determination of who’s at fault and who’s responsible for paying damages in the case. However, if the case cannot settle with the insurance companies, and the case needs to go to court, then ultimately, it will be up to a judge or jury to determine who’s at fault in causing the accident.
