When I say final, what that means is when you file for long-term disability benefits, if you&#8217;re denied, you usually have a right to at least one, if not two, appeals. If the appeal is denied, the insurer will usually identify whether you have <a href=\"https:\/\/www.nickortizlaw.com\/when-you-have-one-mandatory-and-one-optional-appeal-after-a-denial-or-termination-of-benefits\/\" data-type=\"post\" data-id=\"3567\">one more optional appeal<\/a>, you must file a second appeal, or if you&#8217;ve exhausted all of your appeals that you have directly with the insurance company. <\/p>\n\n\n\n<p>So, I&#8217;m talking about when you no longer have the right to file an appeal directly with the insurance company. That&#8217;s when you are deemed to have exhausted your <a href=\"https:\/\/www.nickortizlaw.com\/practice-areas\/long-term-disability-insurance-erisa-lawyer\/appeals\/\" data-type=\"page\" data-id=\"77\">administrative appeals<\/a>. But that doesn&#8217;t mean that&#8217;s the end of the road for your claim.<\/p>\n\n\n\n<p>The insurer should also tell you about your right to file a lawsuit under <a href=\"https:\/\/www.nickortizlaw.com\/ltd-faq\/what-is-erisa-and-what-does-it-have-to-do-with-my-ltd-claim\/\" data-type=\"page\" data-id=\"3578\">ERISA<\/a>. ERISA is short for the Employee Retirement and Income Securities Act of 1974, which applies to most <a href=\"https:\/\/www.nickortizlaw.com\/ltd-faq\/what-is-the-difference-between-individual-and-group-disability-policies\/\" data-type=\"page\" data-id=\"3576\">group insurance plans<\/a>. Although some claims may be subject to an individual plan under state law, most will fall under ERISA.
