What is a day in the life of video?

Hi, I’m Nick Ortiz. I’m a Board Certified Disability Insurance Attorney. Today I’m here to talk to you about why you should consider submitting a “Day In The Live Of Video” to the insurance company during the appeal process.

A “Day In The Life Of Video” is critical for several reasons: First, we’re gonna talk about it’s role in the appeal process. This type of video is useful because it humanizes you. It allows the adjuster who’s reviewing your case to see the exact impact that your condition is having on your life. So if you’re filming how difficult it is for you to move about your house or to go to the store or to engage in any other activities of daily living, than that can be very impactful and humanize your claim for the adjuster. It’s also extremely important in the event that your case needs to go to court.

As you can see from some of my other videos, in an ERISA case, the evidence is very different than any other type of case in fact, you’re not allowed to introduce any new evidence, you’re not allowed to testify. So that’s why if you were to have submitted a “Day In The Life Of Video” during the appeal process, that becomes part of your claim file and it can be used in the litigation and a judge can look at it and see the impact that your condition has had on your life. In a way, it’s a way of you testifying in court.

Finally, it’s a really great negotiation tool. Again, to the extent that it humanizes you, anyone looking at your case, the person who’s deciding whether to settle your case, to pay it out in a lump sum, when they see these videos, they see the impact it’s had on your life and they may be willing to settle your case for a little bit more money. So these are just some of the reasons why a “Day In The Life Of” video is so important and why we encourage you to go ahead and put one together and submit it during the appeal process.
