Hi, I’m Nick Ortiz. I’m a board certified disability insurance attorney.
Today I’m here to talk to you about Unum Life Insurance Company and how they handle long term disability claims.
You may be here because Unum has either denied you claim or terminated your benefits.
I’ll go over some of the reasons why Unum typically denies a claim.
First of all, they may have had your claim reviewed by one of their physicians, in what they call a peer review evaluation. What that means is that they sent your medical records to one of their doctors. And their doctor has given an opinion as to what you can and can’t do. And based upon that doctors opinions, the insurance company says they think you could go back to work.
A second reason why they might deny your claim is based upon a vocational analysis of your claim. What that means is that they’ve sent your file to one of their job experts and their job expert says that based upon it’s review of your file that you can return to work in some capacity.
A third reason why Unum might deny your claim is because they say there is just insufficient medical evidence. They say that “we don’t think “that the medical evidence shows that you’re unable to perform your job or maybe any other job in the economy.”
A fourth reason they might deny or terminate your claim is because there’s a change in the definition of disability from what we call your own occupation to any occupation. This typically occurs after 24 months where they may have approved your case while saying you cannot do the material duties of your job, which is your individual occupation. Which we call “own occ” for short. But they may say that you can do other types of work. Therefore, you could do any occupation. So if they denied you after two years, then you may have the right to appeal that as well.
Those are some of the main reasons why Unum denies claims. However, you may be here for another reason. And that may be because Unum is just flat out taking way too long to issue a decision in your case. So you may be looking for some advice on what your legal rights are, to protect yourself in the event that Unum is not doing what it’s supposed to do and make a decision.
Well that’s what we’re here for. We’re here to assist you in strategizing an appeal in the event that the insurance company has denied you. If you’ve exhausted your appeals, we ‘re here to help you file a lawsuit against the insurance company. And finally, if the insurance company has not issued a timely decision to advise you as to what your legal options are to enforce your rights.
