Our client’s life changed drastically in June 2022, when he suffered cardiac arrest that led to an anoxic brain injury. As a result of his condition, he could no longer work. He filed a claim for long-term disability (LTD) benefits with Mutual of Omaha, and the insurance company initially approved the claim, paying benefits for approximately 27 months.
However, the situation took a turn when United of Omaha abruptly terminated his benefits just before the end of that period. The month before terminating benefits, the insurance company obtained a review from a cardiologist—Dr. Justin Pearlman of Dane Street—who concluded that the claimant should be capable of full-time sedentary work if his employer believed his mental abilities were sufficient.
Notably, Dr. Pearlman deferred to a qualified physician for any assessment of our client’s cognitive impairments.
Despite this, United of Omaha relied on the cardiologist’s opinion and inaccurately stated that the claimant’s neurocognitive studies were also good. Yet, there was no indication that a neuropsychologist had actually reviewed the claim, and this oversimplified assessment did not reflect the true extent of our client’s cognitive limitations following his brain injury.
Our firm stepped in to challenge the termination. We compiled compelling medical evidence, highlighted the insurer’s failure to obtain an appropriate neuropsychological review, and demonstrated that the cognitive impairments were well-documented and disabling. As a result of our appeal, our client’s long-term disability benefits were reinstated.
