After the claimant applied for LTD benefits, Lincoln National initially approved the claim and paid the claimant benefits for nearly a year.
Then, without warning, Lincoln National abruptly terminated the claimant’s LTD benefits. In its denial letter, the insurer stated that “the medical evidence does not support restrictions and limitations that prevent you from performing the material and substantial duties of your Own Occupation.” This reasoning directly contradicted its earlier approval of the claim.
How the Ortiz Law Firm Fought Back
We thoroughly reviewed the claim file and immediately identified critical errors in Lincoln National’s decision. One glaring error was that the insurance company’s reviewing physician falsely claimed that the claim file did not contain a neuropsychological evaluation. However, we proved that the evaluation was in the record and further argued that such an evaluation was not even required under the LTD plan to establish our client’s disability.
In our detailed 23-page appeal letter, we meticulously detailed Lincoln National’s errors and provided substantial medical evidence that our client remained disabled.
